Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and Zyveno LLC, a limited liability company with its principal office at 8206 Louisiana Blvd NE, Albuquerque, NM 87113, US (“Zyveno LLC”, “we”, “us”), which operates ChurnMine (the “Service”). By creating an account, purchasing a plan or otherwise using the Service you accept these Terms. If you use the Service on behalf of an organisation, you confirm you are authorised to bind it.

ChurnMine collects publicly available low-star reviews from third-party platforms (or text you paste or upload), analyses them with automated and AI-assisted methods, and produces “dossiers”: pain clusters, verbatim quotes, scores, ad angles, emails and comparison battlecards.

Output is generated automatically and may be incomplete or inaccurate. Quotes are checked against the source text and marked when they cannot be matched; scores, summaries and suggested copy are analysis, not statements of fact about any company. You are responsible for reviewing output before you rely on or publish it.

• You must provide a valid email address and keep your sign-in and API keys confidential.
• You are responsible for all activity under your account and API keys. Revoke compromised keys immediately.
• You must be at least 18 years old and able to form a binding contract.

• Free preview. Every audit includes a free preview of part of the dossier. Some sources (G2, Capterra, Amazon) require a signed-in account with credits or an active subscription.
• Starter Pack. A one-time purchase of 15 deep-audit credits for $19. Credits do not expire, stack across purchases, have no cash value and are not transferable.
• Agency Pro. A subscription billed monthly in advance at $39 (plus applicable taxes) that renews automatically until cancelled and includes unlimited deep audits subject to fair use (Section 6).

Payments are processed by Stripe. Prices may change with at least 30 days’ notice for subscriptions, taking effect at your next renewal.

You can cancel Agency Pro at any time from Account → Billing. Cancellation stops future renewals; your subscription stays fully active until the end of the billing period you have already paid for, and no refunds or credits are given for partial months. You may resume a cancelled subscription before that date without being charged again until the normal renewal.

Credit packs and subscription periods are non-refundable once purchased, except where required by applicable law or in the case of a billing error (for example a duplicate charge), which you should report to support@churnmine.online within 30 days. Deleting your account cancels any subscription immediately and forfeits unused credits and the remainder of the paid period.

You agree not to:

• use the Service for unlawful, defamatory, harassing or deceptive purposes, including fake reviews;
• publish output that misrepresents a competitor, or use competitor trademarks in ads where prohibited;
• circumvent usage limits, paywalls or rate limits, or share accounts to avoid buying credits;
• run automated traffic at a volume that degrades the Service (“fair use” on unlimited plans);
• reverse engineer or resell the Service, or white-label it beyond the client-report features of your plan, without a written agreement with us;
• upload personal data you have no right to process, or content that infringes others’ rights.

Reviews are collected from third-party platforms that have their own terms. You are responsible for complying with those terms and with advertising, consumer-protection and data-protection laws when you use the output.

You keep ownership of the text you submit and of the dossiers generated for you, to the extent they are protectable. You grant us a limited licence to host, process and display that content to provide the Service, including on share links you choose to enable.

Review text remains the property of its authors and platforms; dossiers quote short excerpts for analysis and commentary. The Service itself — software, design, the ChurnMine name and brand — belongs to Zyveno LLC.

We aim for high availability but do not guarantee uninterrupted service. Review platforms can change or block access at any time, so individual sources may become temporarily or permanently unavailable. We may modify or discontinue features; if we discontinue a paid plan we will offer a pro-rated remedy for prepaid periods.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZYVENO LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST PROFITS OR REVENUE, AND OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

You will indemnify Zyveno LLC against claims arising from your use of the output or your breach of these Terms.

You may stop using the Service and delete your account at any time. We may suspend or terminate accounts that breach these Terms, create risk for other users or the Service, or are required to be closed by law. Sections that by their nature should survive termination (payment obligations, content licences, disclaimers, liability) do so.

These Terms are governed by the laws of the State of New Mexico, USA, without regard to conflict-of-law rules. The state and federal courts located in Bernalillo County, New Mexico have exclusive jurisdiction, except that either party may seek injunctive relief in any competent court. Nothing here limits rights you have as a consumer under mandatory local law.

We may update these Terms. Material changes will be announced by email or in the app at least 14 days before they take effect; continuing to use the Service afterwards means you accept them. The effective date above shows the current version.
